Terms of use

The deal

Create an account, invite people to real events, have a nice time. By creating an account, or by replying to an invitation, you agree to these terms and to the privacy notice. If you do not agree, do not use the site.

Who runs this

Egatherly runs on self-hosted software. The operator of this domain provides the service and is the party these terms are with. Reach them at invite@egatherly.com. The authors of the software are not a party to these terms and have no access to this installation or its data.

Your account

• You must be at least 18 to create an account. Guests need no account and may be any age.
• Give a real email address — it is how you reset a password and how the operator reaches you.
• Keep your password to yourself. What happens under your account is your responsibility until you tell the operator it has been compromised.
• You may add co-hosts to an event. They can see and do everything you can for that event, so choose them accordingly.
• One person, one account. Do not create accounts for other people or by automated means.

Your guest list

Only add people who would expect to hear from you about this event. Do not use the site for marketing, bulk mail, cold outreach, or anything that would make a reasonable person ask "how did they get my number". You are responsible for the addresses and numbers you enter, including having the right to use them.

The operator may limit how many messages an event can send in a day, pause sending that looks like abuse, and remove guest lists that were clearly not built from people the host knows.

Text messages

If text messaging is enabled here, you confirm that each mobile number you enter belongs to someone who has agreed to be texted by you about this event. US law (the TCPA) takes this seriously and so does the operator: every message carries an opt-out, STOP is honoured everywhere and permanently, and a host who texts people without permission loses the feature and possibly the account. Content

• You own what you upload and post — event details, photos, wall posts, messages. You give the operator the limited licence needed to store it, show it to the people you invite, and send it in your invitations and messages. Nothing more.
• Do not post anything illegal, hateful, harassing, sexually explicit, deceptive, or that infringes someone else's rights. Do not upload photos of people who would object to them being shared with the guest list.
• If you mark an event public, its page is listed on this site and may be indexed by search engines. Guest contact details are never made public, but the event details are — do not make something public that should not be.
• Guests may post on an event's wall and album where the host allows it. The host can remove any post or photo on their event and the operator can remove anything.
• The operator may remove content and close accounts that break these terms, and will tell you why unless the law prevents it.

The apps

The iOS and Android apps are for hosts and are offered under these same terms. The app connects to the server you sign in to; if that is not this installation, that server's operator and terms apply to what is stored there. The apps are distributed through the Apple App Store and Google Play under those stores' standard terms, which Apple and Google require and which you accept by installing.

Cost

There is no charge for any feature, and no feature is moved behind a payment. Your mobile carrier may charge you for text messages and data. If this installation ever introduces charges, that is the operator's decision, will be announced in advance, and is not part of these terms.

What is not promised

The service is provided as it is and as available. There is no guarantee that the site is always up, that every email, text or notification arrives, that a reminder goes out on time, or that a headcount is right. Email and text delivery depend on mail servers, carriers and spam filters outside anyone's control. Check your own guest list before buying the food.

To the fullest extent the law allows, the operator is not liable for indirect, incidental or consequential losses arising from use of the service, including a message that did not arrive, an event that went wrong, or content a host or guest posted. Where liability cannot be excluded it is limited to the amount you paid for the service, which is nothing.

Ending things

• You can delete any event, or your whole account, at any time from the site. Deletion is immediate and permanent.
• The operator can suspend or close an account that breaks these terms, is used for abuse, or has been inactive for a very long time — with notice by email where practical.
• The operator may stop running this installation. If that happens, hosts get reasonable notice to export their guest lists first.

Changes to these terms

Small changes — wording, a new feature described — may happen without notice; the date at the top moves. Changes that affect your rights are announced to hosts by email before they take effect. Continuing to use the site after that is agreement.

The legal bit

These terms are governed by the law of the place where the operator is based, and disputes go to the courts there. If any part of these terms is found unenforceable, the rest still applies. These terms, the privacy notice and the text messages page are the whole agreement between you and the operator about this service.
